Algemene voorwaarden

Welkom bij onze Algemene Voorwaarden in het Nederlands, Engels en Frans. Hier vindt u de belangrijkste regels en voorwaarden met betrekking tot onze fotografiediensten, levering, betaling en rechten en plichten van beide partijen. Wij streven naar duidelijkheid en transparantie, zodat u met vertrouwen met ons samenwerkt.

 

Algemene Voorwaarden Nederlands: TdProjectPhotoGraphy

De onderstaande voorwaarden zijn van toepassing op alle facturen, offertes, aanbiedingen, promoties, bestellingen, overeenkomsten en leveringen van diensten of producten door of namens TdProjectPhotoGraphy. Afwijken van deze voorwaarden is uitsluitend mogelijk indien dit expliciet en schriftelijk is overeengekomen tussen beide partijen.

1. Offertes en Aanbiedingen

Aanbiedingen en niet-ondertekende offertes zijn vrijblijvend, tenzij anders aangegeven. Een door de klant ondertekende en/of geaccepteerde offerte wordt als bindend beschouwd. Indien een voorschot wordt betaald, wordt de offerte eveneens bindend. Offertes en aanbiedingen zijn maximaal één week geldig, tenzij anders vermeld. Bij niet-tijdige aanvaarding vervalt de offerte automatisch. Offertes gelden niet voor nabestellingen, tenzij schriftelijk overeengekomen.

2. Aanvaarding van Offertes

Door het accepteren van een offerte gaat de klant akkoord met de algemene voorwaarden van TdProjectPhotoGraphy en alle bepalingen in de offerte. Wijzigingen kunnen alleen plaatsvinden met wederzijdse instemming. TdProjectPhotoGraphy behoudt zich het recht voor om de prijs van de overeenkomst aan te passen indien noodzakelijk.

3. Betalingen en Betalingstermijnen

3a. Voorschot: Bij het ondertekenen of accepteren van een offerte betaalt de klant een voorschot van 30%. Dit voorschot impliceert de aanvaarding van de algemene voorwaarden. Het resterende saldo dient uiterlijk 7 dagen vóór de fotoreportage te worden voldaan. Voor last-minute boekingen (binnen 7 dagen voor de reportage) is een directe betaling vereist.

Betalingen dienen te worden voldaan op rekeningnummer: BE81 7340 5505 8724.

3b. Niet-betaling: Bij achterstallige betalingen is wettelijke rente verschuldigd vanaf de vervaldatum, plus een administratieve kost van €25 per herinnering. Indien nodig schakelt TdProjectPhotoGraphy een incassobureau in. Alle bijkomende kosten worden doorberekend aan de klant.

4. Prijzen

Alle prijzen zijn in euro's. De tarieven voor extra uren bedragen €90 per uur tussen 07:00 en 22:00 uur, en €120 per uur tussen 22:00 en 07:00 uur, en dienen direct ter plaatse betaald te worden.

5. Annulering door de Klant

5a. Huwelijksreportages

Annuleren kan kosteloos binnen 7 dagen na ondertekening van de offerte. Bij annulering tussen 7 dagen en 30 dagen vóór de reportage is 30% van het totale bedrag verschuldigd. Vanaf 30 dagen vóór de reportage is het volledige bedrag verschuldigd. Alle annuleringen dienen per e-mail (info@tdprojectphotography.be) te worden doorgegeven.

5b. Andere Reportages

Bij annulering binnen 7 dagen vóór de reportage wordt het volledige bedrag in rekening gebracht. Annuleringen buiten deze termijn brengen 30% annuleringskosten met zich mee. Alle annuleringen dienen per e-mail te worden gemeld.

6. Annulering door TdProjectPhotoGraphy

Bij overmacht (bijvoorbeeld natuurrampen, ziekte van de fotograaf, of overheidsmaatregelen) behoudt TdProjectPhotoGraphy zich het recht voor de opdracht te annuleren. Indien geen vervangende fotograaf kan worden gevonden, ontvangt de klant een tegoedbon ter waarde van de opdracht.

7. Uitstel van de Opdracht

Bij uitstel binnen 20 dagen na ondertekening van de offerte kan de reportage kosteloos worden verplaatst, mits binnen hetzelfde boekjaar en onder voorbehoud van beschikbaarheid. Uitstel na 20 dagen brengt 10% extra kosten met zich mee, exclusief eventuele reiskosten.

8. Uitvoering van de Opdracht

De fotograaf voert de opdracht uit naar beste inzicht en vakmanschap. De selectie en levering van foto’s gebeuren volgens de overeenkomst en in de gebruikelijke stijl van TdProjectPhotoGraphy. Extra nabewerking is mogelijk tegen meerprijs.

9. Locaties

De klant kiest de locatie voor de fotoshoot en is verantwoordelijk voor alternatieven bij slecht weer. Nieuwe afspraken of extra studio-opnamen kunnen worden ingepland tegen een meerprijs.

10. Afdrukken en Verzending

Afdrukken kunnen worden besteld bij de fotograaf. Alle kosten, inclusief verzendkosten, zijn voor de klant, tenzij anders overeengekomen.

11. Levering van Foto’s

Foto’s worden digitaal geleverd in hoge resolutie (JPEG). Bij verlies kan een kopie worden aangevraagd tegen €25 voor een standaardshoot of €100 voor een huwelijksreportage of andere evenement.

12. Technisch Materiaal

TdProjectPhotoGraphy is niet aansprakelijk voor technische defecten of diefstal van apparatuur tijdens de opdracht.

13. Schade

TdProjectPhotoGraphy is niet verantwoordelijk voor onopzettelijke schade aan eigendommen op de locatie.

14. TFP Reportages

Bij no-show van het model zonder annulering wordt €90 in rekening gebracht. Annuleren dient per e-mail (info@tdprojectphotography.be) te gebeuren.

15. Intellectuele Eigendom

Alle foto’s blijven eigendom van TdProjectPhotoGraphy. Bewerken of wijzigen zonder toestemming is verboden. Foto’s mogen niet zonder overleg worden gepubliceerd.

16. Extra Fotografen

Andere fotografen mogen alleen worden ingehuurd met toestemming. Gasten mogen foto’s maken zolang dit het werk van TdProjectPhotoGraphy niet hindert.

17. Contact

Vragen, wijzigingen of annuleringen kunnen worden doorgegeven via info@tdprojectphotography.be. Annuleringen moeten schriftelijk of per e-mail worden ingediend.

18. Toepasselijk Recht

Op alle overeenkomsten is Belgisch recht van toepassing. Geschillen worden behandeld door de bevoegde rechtbank in de regio waar TdProjectPhotoGraphy is gevestigd.

 

 

 

General Terms and Conditions English: TdProjectPhotoGraphy

The terms and conditions below apply to all invoices, quotations, proposals, promotions, orders, agreements, and deliveries of services or products by or on behalf of TdProjectPhotoGraphy. Deviations from these terms are only possible if explicitly agreed in writing by both parties.

  1. Quotes and Proposals

Offers and non-signed quotations are non-binding unless stated otherwise. A customer-signed and/or accepted quotation is binding. If a deposit is paid, the quotation is also binding. Quotes and offers are valid for a maximum of one week unless stated otherwise. If not accepted in time, the quotation expires automatically. Quotations do not apply to reorders, unless agreed in writing.

  1. Acceptance of Quotes

By accepting a quotation, the customer agrees to TdProjectPhotoGraphy’s general terms and the terms in the quotation. Changes can only be made by mutual agreement. TdProjectPhotoGraphy reserves the right to adjust the price of the agreement if necessary.

  1. Payments and Payment Terms

3a. Deposit: When signing or accepting a quotation, the customer pays a deposit of 30%. This deposit implies acceptance of the general terms. The remaining balance must be paid no later than 7 days before the photoshoot. For last-minute bookings (within 7 days of the shoot), immediate payment is required.

3b. Non-payment: In case of late payment, legal interest is due from the due date, plus a €25 administrative cost per reminder. If necessary, TdProjectPhotoGraphy will engage a collection agency. All ancillary costs will be charged to the customer.

  1. Prices

All prices are in euros. Rates for extra hours are €90 per hour between 07:00 and 22:00, and €120 per hour between 22:00 and 07:00, and must be paid on-site.

  1. Cancellation by the Client

5a. Wedding reports

Cancellation is free within 7 days after signing the quotation. Cancellations between 7 and 30 days before the report are payable at 30% of the total amount. From 30 days before the report, the full amount is due. All cancellations must be communicated by email (info@tdprojectphotography.be).

5b. Other Reports

Cancellation within 7 days before the report is charged at the full amount. Cancellations outside this window incur 30% cancellation costs. All cancellations must be reported by email.

  1. Cancellation by TdProjectPhotoGraphy

In case of force majeure (e.g., natural disasters, photographer illness, or government measures), TdProjectPhotoGraphy reserves the right to cancel the assignment. If no replacement photographer can be found, the customer receives a credit note equal to the value of the assignment.

  1. Postponement of the Assignment

postponement within 20 days after signing the quotation can be moved at no cost, provided it is within the same financial year and subject to availability. Postponement after 20 days incurs an additional 10% cost, excluding any travel expenses.

  1. Execution of the Assignment

The photographer executes the assignment to the best of their ability and expertise. The selection and delivery of photos occur according to the agreement and in TdProjectPhotoGraphy’s usual style. Additional retouching is available at an extra cost.

  1. Locations

The client selects the location for the shoot and is responsible for alternatives in case of poor weather. New appointments or additional studio shoots can be scheduled for an extra fee.

  1. Prints and Shipping

Prints can be ordered from the photographer. All costs, including shipping, are borne by the client unless otherwise agreed.

  1. Delivery of Photos

Photos are delivered digitally in high resolution (JPEG). In case of loss, a copy can be requested for €25 for a standard shoot or €100 for a wedding report or other event.

  1. Technical Equipment

TdProjectPhotoGraphy is not liable for technical defects or theft of equipment during the assignment.

  1. Damage

TdProjectPhotoGraphy is not responsible for accidental damage to property at the location.

  1. TFP Shoots

For no-show by the model without cancellation, €90 is charged. Cancellations must be made by email (info@tdprojectphotography.be).

  1. Intellectual Property

All photos remain the property of TdProjectPhotoGraphy. Editing or alteration without permission is prohibited. Photos may not be published without consultation.

  1. Additional Photographers

Other photographers may only be hired with permission. Guests may take photos as long as this does not hinder TdProjectPhotoGraphy’s work.

  1. Contact

Questions, changes, or cancellations can be communicated to info@tdprojectphotography.be. Cancellations must be in writing or by email.

  1. Governing Law

All agreements are governed by Belgian law. Disputes are handled by the competent court in the region where TdProjectPhotoGraphy is located.

 

 

 

Conditions générales Français: TdProjectPhotoGraphy

Les présentes conditions générales s’appliquent à toutes les factures, devis, offres, promotions, commandes, accords et livraisons de services ou de produits fournis par TdProjectPhotoGraphy ou pour son compte. Toute dérogation à ces conditions n’est possible que si elle est expressément et par écrit acceptée par les deux parties.

  1. Devis et Offres

  • Les devis et les offres non signés sont sans engagement, sauf indication contraire. Un devis signé et/ou accepté par le client est contraignant. Si un acompte est payé, le devis devient également contraignant. Les devis et offres restent valables au maximum une semaine, sauf indication contraire. En cas d’acceptation tardive, le devis expire automatiquement. Les devis ne s’appliquent pas aux réassorts, sauf accord écrit.

  1. Acceptation des Devis

  • En acceptant un devis, le client accepte les Conditions générales de TdProjectPhotoGraphy et toutes les dispositions du devis. Les modifications ne peuvent intervenir que d’un commun accord. TdProjectPhotoGraphy se réserve le droit d’ajuster le prix de l’accord si nécessaire.

  1. Paiements et Conditions de Paiement 3a. Acompte: Lors de la signature ou de l’acceptation d’un devis, le client paie un acompte de 30%. Cet acompte suppose l’acceptation des conditions générales. Le solde restant doit être payé au plus tard 7 jours avant la séance photo. Pour les réservations de dernière minute (dans les 7 jours précédant la séance), le paiement immédiat est requis.

  • Les paiements doivent être effectués sur le compte: BE81 7340 5505 8724.

3b. Non-paiement: En cas de retard de paiement, des intérêts légaux sont dus à partir de la date d’échéance, plus des frais administratifs de 25 € par rappel. Si nécessaire, TdProjectPhotoGraphy fera appel à une agence de recouvrement. Tous les coûts annexes seront imputés au client.

  1. Prix

  • Tous les prix sont en euros. Les tarifs des heures supplémentaires sont de 90 € par heure entre 07:00 et 22:00, et 120 € par heure entre 22:00 et 07:00, et doivent être payés sur place.

  1. Annulation par le Client 5a. Reportages de mariage

  • L’annulation peut être effectuée sans frais dans les 7 jours suivant la signature du devis. Une annulation entre 7 et 30 jours avant le reportage entraîne des frais de 30% du montant total. À partir de 30 jours avant le reportage, le montant total est dû. Toutes les annulations doivent être communiquées par e-mail à info@tdprojectphotography.be.

5b. Autres Reportages

  • Annulation dans les 7 jours précédant le reportage entraîne des frais équivalents au montant total. Les annulations en dehors de ce créneau entraînent 30% de frais d’annulation. Toutes les annulations doivent être signalées par e-mail.

  1. Annulation par TdProjectPhotoGraphy

  • En cas de force majeure (par exemple catastrophes naturelles, maladie du photographe, mesures gouvernementales), TdProjectPhotoGraphy se réserve le droit d’annuler la mission. Si aucun photographe de remplacement ne peut être trouvé, le client reçoit un avoir équivalent à la valeur de la mission.

  1. Report du Mandat

  • Un report dans les 20 jours suivant la signature du devis peut être effectué sans frais, à condition qu’il reste dans la même année comptable et sous réserve de disponibilité. Un report après 20 jours entraîne des coûts supplémentaires de 10%, hors frais de déplacement éventuels.

  1. Exécution de la Mission

  • Le photographe réalise la mission du mieux possible selon son savoir-faire. La sélection et la livraison des photos se font conformément à l’accord et dans le style habituel de TdProjectPhotoGraphy. Un retouche photo supplémentaire est possible moyennant un coût additionnel.

  1. Lieux

  • Le client choisit le lieu de la séance et est responsable des alternatives en cas de mauvais temps. De nouveaux rendez-vous ou séances en studio supplémentaires peuvent être programmés moyennant un supplément.

  1. Impressions et Expédition

  • Des tirages peuvent être commandés auprès du photographe. Tous les coûts, y compris les frais d’expédition, sont à la charge du client, sauf accord contraire.

  1. Livraison des Photos

  • Les photos sont livrées numériquement en haute résolution (JPEG). En cas de perte, une copie peut être demandée pour 25 € pour une séance standard ou 100 € pour un reportage de mariage ou tout autre événement.

  1. Matériel Technique

  • TdProjectPhotoGraphy décline toute responsabilité pour les défauts techniques ou le vol de matériel pendant la mission.

  1. Dommages

  • TdProjectPhotoGraphy n’est pas responsable des dommages involontaires causés aux biens à l’emplacement.

  1. TFP Shoots

  • En cas de no-show du modèle sans annulation, 90 € seront facturés. Les annulations doivent être effectuées par e-mail à info@tdprojectphotography.be.

  1. Propriété Intellectuelle

  • Toutes les photos restent la propriété de TdProjectPhotoGraphy. Modifier ou altérer sans autorisation est interdit. Aucune publication des photos sans consultation.

  1. Autres Photographes

  • D’autres photographes ne peuvent être embauchés qu’avec autorisation. Les invités peuvent prendre des photos tant que cela n’entrave pas le travail de TdProjectPhotoGraphy.

  1. Contact

  • Questions, modifications ou annulations peuvent être communiquées à info@tdprojectphotography.be. Les annulations doivent être formulées par écrit ou par e-mail.

  1. Droit Applicable

  • Tous les accords sont régis par le droit belge. Les litiges seront soumis au tribunal compétent de la région où TdProjectPhotoGraphy est établi.
